executive's proposal seeks to regulate the right to consultation, as guaranteed under Article 6 of Convention 169 of the International Labour Organization, is divided into 2 chapters. The first is composed of 8 items that raise the general and the second consists of 12 articles that present the procedure to be followed by consultations with indigenous peoples.
For space not analyze section by section, not because it's not worth doing the exercise, which would show that the proposal lacks legal support, political, theoretical, and instead of filling creates and generates more conflicts, first between the State and indigenous peoples-fighting that remain from the construction of the Guatemalan State to the present.
Second, between indigenous peoples and extractive industries, the destruction of their habitat and, third, to the internal of the communities, who before the installation of mega projects in their territories, a percentage not to exceed 2 percent the employed population with starvation wages ends up defending a business, not because they share the kind of "development", but because they have a job conditioned by companies and manipulated by their condition of extreme poverty. Therefore, as long as employees become advocates and agitators, even if it means placed against their own communities. Tragic examples are the 12 communities of San Juan Sacatepequez, where 98 percent of the population does not support the installation of a cement versus 2 percent that if you support because they are workers. Similarly situated communities living around the Marlin gold mine in San Miguel community, San Marcos, and the same applies in El Estor, Izabal, about the company that extracts nickel.
Another problematic points of the proposal is the integration of the Advisory Commission, raised in Section 7, the first chapter, as delegates representing the members of the indigenous peoples COCODEs, COMUDES and Coded when extensive studies have shown that these are placed on your finger and not representative of community interests, but respond a special advantage of who governs the country. The requirement of a series of customized dedicated to ancient authorities to attend, ban the right to participate on equal terms.
